Understanding Bail

A clear look at how bail works — and your responsibilities as a co-signer — before, during, and after the process.
How bail works
When someone is arrested, a judge sets a bail amount — a financial guarantee that the defendant will return for all scheduled court appearances. Bail allows release from custody while the case is pending.
Most people can't pay the full amount out of pocket. That's where a licensed bail bond agent comes in. Instead of the full amount, you pay a non-refundable premium of 10% to the agency, which then posts a surety bond with the court for the full bail, securing release.
Once the case concludes — through dismissal, acquittal, or sentencing — the bond is exonerated (released). The 10% premium is the agent's fee for the service and is not returned.
For example
If bail is set at $50,000, you pay a $5,000 premium. We guarantee the full $50,000 to the court on your behalf.
Co-signer responsibilities
As the indemnitor signing for release, you take on these obligations:
Court appearance guarantee
You ensure the defendant appears at every scheduled court date.
Financial liability for FTA
If the defendant fails to appear, you become liable for the full bail amount.
Non-refundable premium
The 10% premium is non-refundable once bail has been posted.
Collateral may be required
Larger bonds may require collateral such as property or vehicles.
